As the jail's gate reached the prisoner it is required to know.
First, specially whether the prisoner was in such lawful custody as to make the facts support an indictment for rescue.
Secondly, generally whether after the Magistrate has passed judgment, and directed a commitment for trial, it is competent to him to detain the defendant in custody by verbal order, for a reasonable time, in a place usually devoted to this purpose, until the Clerk shall have completed the written warrant.
